OFFICE MEMORANDUM

Sub:-Reimbursement of medical claims to pensioners under CS (MA) Rules, 1944 as directed by various CATS/Courts - Regarding.

            The undersigned is directed to state that various references are being received in Ministry of Health and Family Welfare on the above mentioned subject. it is hereby clarified that CS (MA) Rules, 1944 are not applicable to pensioners till date.

2.         It is further informed that the following options to avail medical facilities are available to Central Government pensioners:

a)         Pensioners residing in CGHS covered areas:

1) They can get themselves registered in CGHS dispensary after making requisite contribution and can avail both OPD and IPD facilities.

2). Pensioners residing in CGHS areas cannot optout of CGHS and avail any other medical facility {i.e. Fixed Medical Allowance). Such pensioners, if they do not choose to avail CGHS facility by depositing the required contributions, cannot be granted Fixed Medical allowance in lieu of CGHS.

b) Pensioners residing in non -CGHS areas:

1). They can avail Fixed Medical Allowance (FMA) @ Rs.500/- per month

2) They can also avail benefits of CGHS- [OPD and IPD] by registering themselves in the nearest CGHS “city after“making the required subscription.

3) They also have the option to avail FMA, for OPD treatment and CG HS for IPD treatments after making the required subscriptions as per CGHS guidelines.

3.         In view. of the above, reimbursement of medical claims to pensioners under CS (MA) Rules, 1944 as directed by various CATS/Courts, need not be referred to the Ministry of Health and Family Welfare. The respective Administrative Department/Ministry may take their own decision in this regard.

4.         further, all Departments/Ministries are requested to intimate their employees proceeding for retirement regarding the above options for medical facilities available to the Central Government pensioners.

5. This issues with the approval of competent authority.

Subject: Regarding allotment of GPF Account Numbers to Casual Labourers with temporary status.

Sir,
            Reference is invited to Directorate’s letter No. 01-07/2016-SPB-I of even No. dated 12.09.2016 vide which clarifications in respect of Casual Labourers with temporary status were issued. The Directorate has received references from Postal Circles seeking clarification as to whether GPF account numbers should be allotted to Temporary Status Casual Labourers covered under the Scheme formulated vide Directorate’s letter No. 45-95/87-SPB-I dated 12.04.1991.

2.         In this regard, it is clarified that Directorate’s letter No. 01-07/2016-SPB-I dated 22.07.2016 restores the provisions of the scheme as it existed prior to this Department’s letter no. 45-6/2005-SPB-I dated 02.09.2005. Since, the benefit of GPF was available to temporary status Casual Labourers prior to 02.09.2005, GPF account numbers may be allotted to such Casual Labourers for the purpose of contribution in GPF including those Temporary Status Casual Labourers who have not been regularized as yet. In this context, provisions of above said letter, dated 12.09.2016 may also be taken into consideration.

            Your kind attention is drawn to para-3 of the above referred OM dated 26.04.2017.

            Para – 3 – “In future, GDS who are willing to work as substitute will be paid at the minimum pay of the respective levels of the Pay Matrix barring other allowances like HRA, Transport Allowance etc. with effect from 01.01.2016.”

            The words, “in future “appearing at the beginning of the above para creates an impression that enhanced substitute wage is eligible from date of issue of the orders only, whereas the words “with effect from 01.01.2016” appearing in the last line of the same para gives an impression that the revised substitute wage should be paid from 01.01.2016.

            As the minimum pay of the Postmen, Mailguard and MTS is revised with effect from 01.01.2016, the substitutes shall be paid the revised wages with effect from 01.01.2016 itself on the principle of equal pay for equal work. But the framing of the para – 3 has created confusion as the meaning of the whole para is ambiguous. As a result many lower level authorities had refused to pay revised substitute wages with effect from 01.01.2016.

            It is requested to issue necessary clarification removing the ambiguity appearing in para- 3 of the OM.

INTENSIFY STRUGGLE AGAINST NPS
CONFEDERATION OF CENTRAL GOVERNMENT EMPLOYEES & WORKERS

AND

ALL INDIA STATE GOVERNMENT EMPLOYEES FEDERATION
JOINTLY ORGANIZE
NATIONAL CONVENTION ON NPS
ON 10th June 2017 Saturday

Venue:   MPCU SHAH AUDITORIUM, CLUB ROAD, LUDLOW CASTLE, CIVIL LINES, DELHI – 110054 (Near Civil Lines Metro Station)

About 1000 delegates from all affiliates/states will participate.
As per the decision of the joint meeting of Confederation and AISGEF, it is decided to organize a National Convention on NPS (Contributory Pension Scheme) at New Delhi on 10th June 2017 at MPCU Shah Auditorium from 2 PM to 6 PM. The main intention of the National Convention is to intensify the struggle against the NPS (Contributory Pension Scheme) and also against large scale outsourcing of Government functions. Eventhough initially the convention is organized by Confederation and AISGEF only, many other like-minded organisations in many public sector undertakings like Banks, Insurance, BSNL, Pensioners organisations etc. shall join the struggle in future and efforts are on to make it a bigger platform and biggest movement against the NPS and outsourcing which are imposed as a part of policy offensives of those Governments implementing neo-liberal reforms.


Out of 1000 delegates AISGEF will mobilise 650 and Confederation 350. All affiliates organisations and C-O-Cs of Confederation shall mobilise delegates from all states. Major organisations shall mobilise maximum (NFPE – 100, ITEF-50, Audit-20, Civil Accounts-20, Atomic Energy-10, Ground Water Board-20, others – 5 each, C-O-Cs-Delhi – 50 others – 5 each). Please start the mobilization and campaigning now onwards to ensure participation of delegates as per the above quota from all organisation and also from all states.


Detailed future course of programme of action will be announced in the Resolution to be adopted in the National Convention. As almost 40 to 50% of the Central an State Government employees comes under the purview of NPS, efforts may be made to reach out to all those younger generation employees and to ensure their full participation in the struggle programmes to be announced by the National Convention.

ON 22nd JUNE 2017, THURSDAY

As already reported the entire Central Government employees and pensioners are very much aggrieved and agitated over the totally indifferent and negative attitude of the NDA Government against their genuine and legitimate demands. Their anger and protest was visible in the 16th March 2017 one day strike and also in the mass dharna organized in front of Finance Minister’s office and other state/District Centres on 23.05.2017. As the dominant organisations in the NJCA and also JCM National Council Staff Side are not ready for reviving the deferred indefinite strike, the entire employees and pensioners including Autonomous body employees and Pensioners are looking at Confederation as the only organisation of hope which is sincere to their cause.


As the next phase of our agitation, Confederation National Secretariat has decided to organize HUMAN CHAIN OF CENTRAL GOVERNMENT EMPLOYEES AND PENSIONERS ON 22.06.2017, Thursday, in front of all major Central Government offices at all major Centres. The time can be either lunch hour on any other convenient time fixed locally. Leaders of all fraternal organisations who are supporting our cause may also be invited to be a part of the human chain.

Maximum participation of employees and pensioners may be ensured in the programme. The draft pledge (Oath) to be taken by the participants of the human chain (which may be announced by one leader through sound amplifier and repeated by all participants) will be exhibited in the Confederation website shortly. The same may be translated to local language and printed copies distributed to all participants of the human chain. Big and long banners are to be exhibited in front of the human chain with name of Confederation and demands prominently written on it. If possible a meeting of all participants may be arranged after the pledge (after the human chain) and leaders may address such meetings. Maximum publicity should be given through print and electronic media and also social media.

MASS DHARNA IN FRONT OF FINANCE MINISTER’S OFFICE A RESOUNDING SUCCESS

ABOUT 3000 CENTRAL GOVERNMENT EMPLOYEES AND PENSIONERS RALLIED IN FRONT OF NORTH BLOCK, THE CENTRE OF GOVERNANCE OF GOVERNMENT OF INDIA
AN OUTBURST OF PROTEST, ANGER, RESENTMENT AND DISCONTENTMENT AGAINST THE BETRAYAL OF NDA GOVERNMENT



The mass dharna organized in front of Union Finance Minister’s office at North Block, New Delhi was a thundering success. Inspite of repeated intervention of the police authorities and also denial of police permission in the last minute, employees and pensioners poured in thousands from all parts of the country and defeated the attempt of the authorities to prevent the Confederation from conducting the dharna at the declared venue, North Block, the centre of governance of Govt. of India. About 3000 employees and pensioners participated. As South Block and North Block are highly protected security zone in Delhi, during the last more than 15 years, no agitational programme could be organized near South/North Block. The dharna participants included employees from various affiliates of Confederation, Central Government Pensioners Associations, Autonomous body employees and pensioners. As a mark of solidarity and support of Central Secretariat employees, the leaders of Central Secretaries Employees Associations also participated in the mass dharna. The demands raised in the 21 point charter of demands of Confederation submitted to Government during the 16th May 2017 strike was highlighted. The demands included honour assurance given by the Group of Minister’s on 30.06.2016 to NJCA leaders, Increase minimum wage and fitment formula, grant revised allowances including HRA and Transport Allowance from 01.01.2016, Implement option-I parity recommended by 7th Pay Commission for pre-2016 pensioners, Implement positive recommendations of Kamalesh Chandra Committee Report on GDS and grant Civil Servant Status to Gramin Dak Sevaks, Regularise casual, Part-time, contingent, daily-rated and contract workers and grant equal pay for equal work, implement pay revision of Autonomous body employees and grant revised pension and Dearness Relief to Autonomous body pensioners, withdraw stringent conditions imposed on MACP promotions, Scrap PFRDA Act and withdraw NPS, stop outsourcing, Fill up all vacant posts, remove 5% condition on compassionate appointments, upgradation of pay scale of LDC/UDC, parity in pay to stenographers, Assistants, Ministerial staff in subordinate offices and in all organized accounts cadres with that of Central Secretariat staff etc.

The mass dharna programme was presided by Com. K. K. N. Kutty, National President, Confederation. Coms: M. Krishnan, Secretary General, Confederation, R. N. Parashar, Secretary General, NFPE, Asok Kumar Kanojia, President, ITEF, Tapas Bose, President, Audit & Accounts Associations, R. Seethalkshmi, Convenor, Women’s Sub Committee, M. K. Kaushik, Ghanashyam, Central Secretariat Employees Association, Worlikar, National Federation of Atomic Energy Employees, Srikrishna Sharma, Central Government Pensioners Association, Rajasthan, Jaipur, Giriraj Singh, President, NFPE & COC Delhi addressed the huge gathering. Com. Vrigu Bhattacharjee, Secretary General, Civil Accounts Employees Association & General Secretary, COC Delhi welcomed the dharna participants and Com. Geetha Bhattacharjee, National Secretariat member, offered vote of thanks. The mass dharna commenced at 11 AM and concluded at 2.30 PM. Slogans condemning the betrayal of the Group of Ministers were shouted. 
The successful mass dharna once again proved that it is Confederation and Confederation alone is dare enough to fight against the betrayal of the NDA Government and also against all injustices meted out to the Central Government employees and Pensioners. The unprecedented success of the 16th March 2017 one day strike and the 23rd May 2017 mass dharna programme is a clear message to the Government that Confederation shall not rest, till the genuine and justified demands of the Central Government employees and Pensioners are settled.
Let us march forward to our next programme i.e; HUMAN CHAIN of Central Government Employees and Pensioners in all major cities in front of all important offices on 22nd June 2017.

NFPE & AIPEU-GDS DECLARE

GDS MARCH TO COMMUNICATIONS MINISTER’S OFFICE (SANCHAR BHAWAN) ON 27TH JULY 2017 THURSDAY 11AM AT NEW DELHI

About 5000 Gramin Dak Sevaks will march to Sanchar Bhawan (Communications Minister’s office) demanding:

1.  Immediate implementation of Positive recommendations of Kamalesh Chandra Committee Report on GDS. Grant Civil Servant Status to Gramin Dak Sevaks.

2.  Conduct GDS membership verification immediately as more than five year is over since last verification. Stop patronizing Govt. sponsored unions.

Dear Comrades,

As you are aware, the Kamalesh Chandra Committee on GDS has submitted its report to Government on 24.11.2016. Now six months are over. The report is still pending in the Postal Board. After the approval of Postal Board the report is to be approved by Communications Minister, Department of Personnel, Law Ministry, Finance Ministry and finally Cabinet.

Government is trying to delay the implementation of the report indefinitely. It will take another one year, as per the existing file movement at Directorate. The recognised GDS Union has miserably failed and called off the indefinite strike without any settlement. Both recognised GDS Union and BMS union are indirectly supporting the Government’s plan to delay the GDS committee report and are cheating the GDS employees. NFPE and AIPEU-GDS cannot allow this situation to go unchallenged.

Similarly GDS membership verification process is also indefinitely delayed, after calling for application from the unions/Association. Already five years are over after the last membership verification. The recognised GDS Union is afraid of membership verification and has given a letter to the Postal Board to postpone the membership verification. BMS Union also don’t want verification as they will not get recognition. Thus, both recognised GDS Union and BMS Union are playing with the Government and they cannot conduct any serious agitational programmes against the Government. Only NFPE & AIPEU-GDS can fight against the negative attitude of the NDA Government.

NFPE & AIPEU – GDS has decided to organize serious agitaitonal programmes on the above two GDS demands culminating in strike. Before declaring the strike date, NFPE & AIPEU-GDS has decided to organize a massive GDS March to the Communication’s Minister’s office (Sanchar Bhawan) on 27th July 2017 at 11 AM. About 5000 Gramin Dak Sevaks from all the Circles (States) will participate in the historic Sanchar Bhawan March.

NFPE & AIPEU-GDS (CHQ) calls upon the entire Postal employees, especially Gramin Dak Sevaks, to mobile maximum number of employees and make the Sanchar Bhawan March a thundering success.

We shall not rest, till GDS employees demands are settled.

For details please the circular published below. Venue of the DHARNA is Tikona Park , North Block , New Delhi adjacent to the Finance Ministry office, Opposite Gate Number 14 and Post office . All are requested to reach the North Block through road from Gurdwara Rakabgang side. All City buses terminating at Central Secretariat shall drop the DHARNA participants at North Block which is not more than fifty (50) meters from DHARNA spot. Nearest Metro station is Central Secretariat which is barely one kilometer away away from DHARNA spot. A walk from the metro station keeping the Parliament building on the left - hand side shall lead to the DHARNA spot. DHARNA will start at 12 noon. INTERACTION WITH IPOS PROBATIONERS

Com. R. N. Parashar, Secretary General, NFPE & General Secretary, P3 was invited by Director, Rafi Ahmed Kidwai National Postal Academy, Ghaziabad (Uttar Pradesh) to interact with IPOs probationers on topic “Dealing with human resources in Department. (i) Staff Relation (ii) Service Union on 19th May 2017”.

 A key note address by Com. Parashar was presented before IPOs probationers and reply of queries and questions raised by the probationers was given. Besides the subject given above the history of trade union movement, Impact of neo-liberal economic policies on Government Sector and 7th Pay Commission related issues were also presented before the IPOs probationers.

A warm welcome was extended by the administration of RAKNPA Ghaziabad to Secretary General, NFPE,

Shri P. K. Bishoi, Director and Sri Vinay Tiwari Additional Director were also present on the occasion.
